ERISA Litigation, you may recall an entry in January of this year entitled “Directors and the Duty to Monitor Under ERISA” where I discussed the DOL’s Amicus Brief filed in the case and the issue being debated regarding the scope of the appointing fiduciary’s duty to monitor appointed fiduciaries under ERISA.
